Theo Hiệp hội bất động sản Việt Nam (VNREA), quy định sau khi hoàn thành công trình và chuyển giao công trình cho nhà nước, nhà đầu tư mới được thanh toán, chuyển giao quỹ đất đối ứng dẫn tới thời gian thanh toán bị kéo dài, gây thiệt hại cho nhà đầu tư.

Giao đất sau khi thực hiện xong 50% công trình?

Trong bảng tổng hợp một số kiến nghị nhằm tháo gỡ khó khăn đối với thị trường bất động sản gửi Bộ Xây dựng và Thủ tướng Chính phủ, VNREA có nhắc đến vấn đề quỹ đất đối ứng để thanh toán cho nhà đầu tư thực hiện dự án theo hình thức hợp đồng – chuyển giao (BT).

VNREA cho biết, chỉ có khoản 3 Điều 155 Luật Đất đai quy định về việc Nhà nước giao cho nhà đầu tư quản lý diện tích đất để thực hiện dự án. Ngoài ra, không có quy định cụ thể nào về loại đất, giá trị đất đai để trả cho nhà đầu tư khi thực hiện dự án BT.

Nghị định 63/2018/NĐ-CP ngày 04/5/2018 về đầu tư theo hình thức đối tác công tư quy định tương đối chi tiết về trình tự, thẩm quyền cũng như phương thức lựa chọn nhà đầu tư thực hiện dự án theo hình thức hợp đồng BT.

“Tuy nhiên, đặt trong mối quan hệ với Luật đất đai các vấn đề liên quan đến việc thực hiện dự án theo hình thức hợp đồng BT chưa đầy đủ và bao quát hết các nội dung”, VNREA đánh giá.
